Terms of Service
These terms govern use of the Myometric website and purchases made through it. They are provided by Open Bionics Ltd, trading as Myometric.
These terms apply to your use of the Myometric website and to orders placed through it. The seller and website operator is Open Bionics Ltd, trading as Myometric, company number 09001817, registered office Programme, Tower Lane, Bristol, England, BS1 2NB.
If you need to contact us about these terms or an order, email hello@myometric.com.
Website use
You may use this website only for lawful purposes. You must not misuse the website, attempt to interfere with its operation, try to gain unauthorised access to systems or data, or use the site in a way that could harm us, other users, or third parties.
Product information
We aim to ensure that product descriptions, pricing, availability, and technical information are accurate. However, images, descriptions, and specifications are provided for general information and may be updated from time to time. Availability is not guaranteed until an order is accepted.
Orders and contract formation
Placing an order through the website is an offer to buy. A contract is formed only when we accept the order. We may decline an order, for example where a product is no longer available, pricing is incorrect, payment fails, or we reasonably suspect fraud or misuse.
Prices and payment
Prices shown on the website are the prices applicable at the time of order, unless an obvious error has occurred. Payment is processed via Stripe. By submitting payment details, you confirm that you are authorised to use the selected payment method.
Delivery
Delivery times are estimates unless we state otherwise. We are not responsible for delays outside our reasonable control, but we will try to keep you informed where such delays materially affect fulfilment.
Consumer cancellation and returns
If you are a consumer purchasing at a distance from within the UK, you may have statutory rights to cancel within the applicable cooling-off period, subject to any lawful exceptions. Those statutory rights are not excluded by these terms.
Where goods are faulty, not as described, or not of satisfactory quality, consumers may also have remedies under applicable consumer law. Nothing in these terms limits those non-excludable rights.
Business customers
If you are ordering on behalf of a business, research institution, clinic, team, or other organisation, you confirm that you have authority to bind that organisation. Unless mandatory consumer law applies, your purchase is treated as a business transaction.
Liability
Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, or other liability that cannot be excluded under law.
Subject to that, we are not liable for indirect or consequential loss, loss of profit, loss of business, or loss of data arising from use of the website or delay or failure in performance, except where such exclusion would be unlawful or unfair.
Website availability
We do not guarantee that the website will always be available, uninterrupted, or error-free. We may suspend, withdraw, or update the site where reasonably necessary.
Intellectual property
Unless otherwise stated, the content, branding, copy, graphics, and other materials on this website belong to us or our licensors. You may not reproduce, distribute, or exploit them except as permitted by law or with our prior written permission.
Governing law
These terms are governed by the laws of England and Wales. If you are a consumer, you may also benefit from mandatory protections of the law of the country in which you live. Where permitted, disputes will be subject to the courts of England and Wales.
Changes to these terms
We may update these terms from time to time. The version displayed on this page will apply to your use of the site and, unless otherwise required by law, to new orders placed after the updated version is published.
